This Club Subscription Agreement governs your use of Game Set Engage as a club. It supplements, and forms part of, our Terms of Service and should be read together with our Privacy Policy. If there is a conflict between this Agreement and the Terms of Service on a club-specific matter, this Agreement controls.
Who This Agreement Applies To
This Agreement applies to club owners and club team members who create or manage a club on the platform. The club owner is responsible for their team members' use of the Service and for all activity under the club account.
Subscription Plans
We offer subscription plans at several tiers, each with a different active-user capacity:
- Local — for small communities
- City — for growing clubs
- National — for large clubs
- Global — for the largest organizations
Current plan names, user limits, prices, and overage rates are published on our Pricing page, which is the authoritative source. Plans may include a maximum number of active users; usage above that limit incurs per-user overage fees at the rate stated for your plan.
Billing and Payment
- Subscription fees are billed in advance on a monthly or annual basis through our third-party payment processor
- All fees are quoted in US dollars unless otherwise specified
- Auto-renewal: subscriptions renew automatically for successive periods until cancelled. You may cancel future renewals at any time from your dashboard; cancellation takes effect at the end of the current paid period
- You authorize us to charge your payment method for all applicable fees, including overage charges
- We will provide at least 30 days' written notice before any price increase takes effect
- Fees are non-refundable except where required by applicable law
- Failure to pay may result in suspension or termination after written notice and a reasonable cure period
Data Roles and Processing
When you use the Service to collect and manage fan data, you (the club) act as the data controller and GSE acts as the data processor on your behalf for that processing. You are responsible for having a lawful basis for the fan data you process through the platform and for your own compliance with applicable data protection laws.
For certain activities (such as engagement-points calculation and campaign analytics), GSE and the club may act as joint controllers under GDPR Article 26. A Data Processing Addendum (DPA) that meets GDPR Article 28 requirements is incorporated into this Agreement by reference for clubs that process data of EU/EEA or UK residents; the current DPA is available from dpo@gamesetengage.com. Club Responsibilities
You agree to:
- Ensure your campaigns comply with applicable laws, including consumer-protection and marketing laws
- Maintain accurate club, event, and campaign information
- Use fan data only for purposes permitted by the platform and applicable data-protection laws
- Not export, scrape, sell, or use fan personal information for purposes outside the Service
- Keep team-member access appropriate and revoke it promptly when someone leaves
Venue Partnerships and Contributions
Clubs may partner with venues, who run check-in campaigns and offers for your fans. Venues make per-event contributions to the club for qualifying fan check-ins and offer redemptions, as configured by the club. GSE facilitates these contributions and retains a commission on them. Contribution rates, commission, and settlement terms are set out in your dashboard and (when payments are enabled) the applicable billing terms. The Venue Partner Agreement governs the venue side of this relationship.
Team Members
Club owners may invite team members to help manage events and campaigns. Team members receive their own login with limited permissions. The club owner remains responsible for all team-member activity and for the lawful use of fan data by the team.
Suspension and Termination
We may suspend or terminate a club account for breach of this Agreement or the Terms of Service, non-payment after notice and a cure period, or where required by law. On termination, your access ends and your data is handled per our Privacy Policy and any applicable DPA. You may close your club account at any time from your dashboard or by contacting us.
Relationship to Other Terms
This Agreement is in addition to our Terms of Service, Privacy Policy, Cookie Policy, GDPR Compliance page, and any applicable DPA. Provisions of the Terms of Service on intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law apply to your use as a club.
