These Fan Terms govern your use of Game Set Engage as a fan. They supplement, and form part of, our Terms of Service and should be read together with our Privacy Policy. Capitalized terms not defined here have the meaning given in the Terms of Service. If there is a conflict between these Fan Terms and the Terms of Service on a fan-specific matter, these Fan Terms control.
Who These Terms Apply To
These Fan Terms apply to you if you create or use a fan account, primarily through the Game Set Engage mobile application (iOS and Android). Fan accounts are free.
Eligibility and Age
You must meet the minimum age to use the Service in your jurisdiction:
- United States: 13 years or older (COPPA)
- European Union: 16 years or older (GDPR Article 8)
- United Kingdom: 13 years or older (UK GDPR)
By registering, you confirm that you meet the applicable minimum age. If we learn that an account belongs to someone below the applicable age, we may suspend or delete it.
Your Account
- Provide accurate registration information and keep it current
- Keep your credentials secure; you are responsible for activity under your account
- One account per person; do not share or transfer your account
- You may close your account at any time; engagement points are forfeited on closure (see below)
Club Subscriptions
You may subscribe to clubs to receive updates, participate in campaigns, and earn engagement points. Each fan may subscribe to a maximum of three (3) clubs at any time. To follow a new club beyond this limit, first unsubscribe from an existing one.
Engagement Points
Our gamification system awards engagement points for legitimate participation. Points are subject to the following rules:
- Points are earned through legitimate campaign participation (check-ins, surveys, deals, and similar)
- Point multipliers vary by check-in location: 5x at the stadium/event, 3x at a partner venue, 1x at home
- Points have no monetary value. They cannot be exchanged for cash, transferred between accounts, or sold
- We may adjust, expire, or revoke points at our discretion, including for fraud such as location spoofing
- Points are forfeited upon account closure
- We may modify the points system, including multipliers and earning rules, at any time with reasonable notice
Campaign Participation
Campaigns include check-ins, deal codes, QR-based campaigns, surveys, and auctions. By participating, you agree that:
- You must be a subscribed fan of the club running the campaign
- Each campaign may have its own eligibility criteria, participation limits, and expiration dates
- We may void participation obtained through fraud, manipulation, or circumvention of campaign rules
- Campaign availability and terms are set by the organizing club and may change without notice
Location and Check-in Data
Location-based campaigns require you to share your precise geolocation at the time of check-in so we can verify where you participated and apply the correct point multiplier. You provide this location data with your consent, and you can disable location access in your device settings — though doing so prevents participation in location-based campaigns. See our Privacy Policy for how location data is handled.
You agree not to falsify your location (for example, using mock-location or GPS-spoofing tools). Doing so may result in voided participation, revoked points, and account suspension.
Auctions
Some campaigns let you bid using engagement points. Auctions are an engagement feature: points used for bidding have no cash value, no purchase is necessary to earn points through normal participation, and prizes (if any) are provided by the organizing club. Auctions may have additional rules presented at the time of the campaign.
Acceptable Use
Your use of the Service is subject to the Acceptable Use section of the Terms of Service, including prohibitions on fraud, location spoofing, harassment, scraping, and unauthorized automated access.
Communications
We send transactional messages (account, security, receipts) as part of the Service. Marketing communications are sent only with your consent where required, and you can opt out at any time.
Termination
You may close your account at any time. We may suspend or terminate your account for violations of these Fan Terms or the Terms of Service, including fraudulent check-ins. Where possible we will provide notice and an opportunity to cure, except for serious violations.
Relationship to Other Terms
These Fan Terms are in addition to our Terms of Service, Privacy Policy, Cookie Policy, and (for EU/UK fans) our GDPR Compliance page. Provisions of the Terms of Service on intellectual property, disclaimers, limitation of liability, dispute resolution, and governing law apply to your use as a fan.
