Acceptance of Terms
By accessing and using Game Set Engage ("the Service"), operated by Game Set Engage LLC ("GSE," "we," "us," or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users, including fans, club owners, club team members, partner venues, account managers, and administrators. Additional terms may apply to specific features, which will be presented to you when you access those features.
Description of Service
Game Set Engage is a sports club engagement platform that enables clubs to connect with their fans, manage events, run engagement campaigns, and partner with venues to create a three-way value ecosystem. The Service includes:
- Web dashboard for clubs, venues, and administrators
- Mobile application for fans (iOS and Android)
- Campaign management tools (check-ins, deals, QR codes, surveys, auctions, and more)
- Event calendar and management system
- Engagement points and gamification system
- Venue partnership and approval workflow
- Real-time notifications and communication tools
User Accounts
Registration and Roles
To access certain features of the Service, you must register for an account. The Service supports multiple user roles: fan, club owner, club team member, partner venue, account manager, admin, and super admin. Each role has different permissions and access levels. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate
- Keep your login credentials secure and confidential
- Not share your account or credentials with any other person
- Notify us immediately of any unauthorized use of your account
Account Responsibility
You are responsible for all activities that occur under your account, whether or not authorized by you. We are not liable for any loss or damage arising from your failure to maintain account security.
Account Termination by You
You may close your account at any time through your account settings or by contacting us. Upon closure, your access to the Service will cease. Your data will be handled in accordance with our Privacy Policy and applicable data retention periods.
Role-Specific Terms
Game Set Engage serves fans, clubs, and partner venues. In addition to these Terms, role-specific terms apply to you depending on how you use the Service. These role-specific terms form part of these Terms; where a role-specific term conflicts with these Terms on a role-specific matter, the role-specific term controls.
- Fans — see the Fan Terms: club subscriptions (a maximum of three clubs), engagement points, check-ins, location data, and campaign participation.
- Clubs — see the Club Subscription Agreement: subscription plans and billing, auto-renewal, data controller/processor roles, and fan-data responsibilities. A Data Processing Addendum is incorporated for clubs processing EU/EEA or UK personal data.
- Partner venues — see the Venue Partner Agreement: partnership approval, venue offers, per-check-in and per-redemption fees, and fan-data limits.
Subscription plans, user limits, and pricing are described in the Club Subscription Agreement and on our Pricing page, which is the authoritative source for current numbers.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Infringe on intellectual property rights of GSE or any third party
- Transmit harmful, offensive, defamatory, or inappropriate content
- Engage in harassment, abuse, bullying, or discriminatory behavior
- Spoof your location or use any means to falsify check-in data
- Create bots, scripts, or automated tools to interact with the Service without authorization
- Interfere with or disrupt the Service, servers, or networks
- Attempt to gain unauthorized access to any systems, accounts, or data
- Scrape, harvest, or collect personal information of other users
- Use the Service for commercial purposes not authorized by your subscription plan
Content and Intellectual Property
Your Content
You retain ownership of content you submit to the Service (such as event notes, profile information, and campaign materials). By submitting content, you grant GSE a non-exclusive, worldwide, royalty-free, sublicensable (solely for the purpose of operating the Service through our hosting and CDN providers) license to use, reproduce, modify, and display that content in connection with operating and improving the Service. This license ends when you delete the content or close your account, except where the content has been shared with other users or is required for legal compliance.
Our Content
The Service and its original content, features, functionality, design system, and branding are owned by Game Set Engage LLC and are protected by copyright, trademark, trade dress, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without express written permission.
Termination by Us
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use policy
- You engage in fraudulent activity, including location spoofing
- Your account is used for illegal activities
- You fail to pay applicable fees after notice and a reasonable cure period
- We are required to do so by law or regulatory order
Where possible, we will provide written notice and an opportunity to cure before termination, except in cases of serious violations or legal requirements.
Disclaimers
Service Availability
We strive to provide continuous, reliable service but do not guarantee uninterrupted or error-free access. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Third-Party Content
Campaigns, venue offers, and content created by clubs and venues are the responsibility of those parties. GSE does not guarantee the accuracy, legality, or quality of third-party content or offers.
Limitation of Liability
To the maximum extent permitted by applicable law, Game Set Engage LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).
Indemnification
You agree to defend, indemnify, and hold harmless Game Set Engage LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service or violation of these Terms
- Content you submit to the Service
- Your violation of any law or the rights of a third party
- For clubs: your use of fan data in violation of applicable data protection laws
- For venues: your use of engagement data outside the scope of the campaign partnership
Dispute Resolution
Informal Resolution
Before filing any formal claim, you agree to first contact us at legal@gamesetengage.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration
If we cannot resolve a dispute informally, you agree that any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. Arbitration will be conducted in the State of Wyoming, in the English language. The arbitrator's award shall be final and binding.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Force Majeure
GSE shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, internet disruptions, power outages, or third-party service failures.
Privacy

Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. For matters not subject to arbitration, the exclusive jurisdiction shall be the state and federal courts located in Wyoming.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with the applicable role-specific terms (Fan Terms, Club Subscription Agreement, or Venue Partner Agreement), our Privacy Policy, Cookie Policy, GDPR Compliance page, and any applicable Data Processing Addendum, constitute the entire agreement between you and GSE regarding the Service and supersede all prior agreements and understandings.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email and by posting notice on the Service at least 30 days before changes take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue using the Service.
